Legal Question in Wills and Trusts in Illinois

my children and i were left out of will

My father died unexpectantly after slipping into a coma. We had a great relationship for the past five years. Prior to that, we had a strained relationship due to the fact that he simply detested my ex-husband. He loved my present husband and we all got along tremendously. He had spoken to me often that he needed to go to his lawyer to get some papers straighted out, unfortunately, he simply didn't get around to it and his present will states that I and my family are to receive nothing for reasons that he deemed appropriate. His estate is in the amount of approximately 4 million and included his stocks and several acres of property. I have not seen a quit claim deed on his house. I know what his more recent wishes were, but it indicates that clause pertaining to me and my children. It also states that anyone contesting the will loses their inheritance, however, since he unfortunately didn't get the chance to change his paperwork, I nor my children receive anything anyway. Do I have any ground to contest this will, or will it just create further distress in the family. The trustee of the will is very confused by it also. They know what my relationship was with my father past and present, please advise me.

I'm sorry to hear of the loss of your father.

It sounds like you truly need to sit down with an attorney who can review the documents for you, and inquire more about the make-up of your father's family. E.g., did he leave a wife, do you have siblings, who are the other beneficiaries and how are they related? In other words, the questions you pose raise numerous others.

Please feel free to e-mail me to discuss further.
