As the executor or my step-father's estate my sister is charging a per hour for travel along with a per mile for any thing she does for the estate. Can she legally charge for both the time and per mile on her travel?

Your sister is entitled to be reimbursed for out of pocket expenses and to be reimbursed for her time at a reasonable rate of compensation. If you do not believe her charges are reasonable, you can file an objection with the court and the jusge will decide what is reasonable. Before proceeding ahead consider what the circumstances would have been if you were the executor. Would you have worked for free? Most people believe serving as an executor is a lot of work and a significant responsibility. Also, carefully read the will to determine if your step-father left any guidelines to determine what is reasonable.
