Legal Question in Wills and Trusts in Illinois

If the executor of a will is not carrying out the duties that is in the best interest of the beneficiaries is there anything that can be done? I don�t believe there is an alternate beneficiary named in the will.

An interested person (beneficiary) can petition the court to hear any issue and/or can ask the court to remove the executor for cause. Generally, parties should attempt to work out differences outside of court first, but if that fails, then it may be appropriate to go in front of the probate judge for a remedy. The ultimate result depends on the particular facts of the situation.
