My father in law passed away recently and left his estate to 3 sons, widow of on son and granddaughter. On his CD and life insurance he sated that on his death that his daughter in law was beneficary. My question is the 1. Is the CD and Life insurance part of the estate and 2. Can she divide the monies as she wants or by the Will.

Beneficiary designations trump the will. The CD and life insurance will go to the daughter-in-law. They are not part of the probate estate. I doubt she will want to divide the money at all.

Having said all of that it is important that you act promptly if you suspect any undue influence with respect to the beneficiary designations. If you would like a free 5 minute chat to see if it makes sense to have a consultation, go to my website at www.legacylaws.com and call my office.
