Legal Question in Wills and Trusts in Illinois

My father passed away last July, leaving an estate to get rid of. My brother was name as executor of the will/estate, BUT the will was never filed with the court (which from what I've read doesn't make the will "totally" legit).

My brother and I don't agree as to the disposition of the estate. I intend on writing a letter saying that I relinquish any claim to my late father's estate. Obviously writing this letter might not keep them from calling me and asking me for $$$ to keep the bills paid until they get the house sold. but,

Question: Is this letter "really" necessary IF the Will was never filed with the court prior to the death of my parent/s?

thanks much!

I wonder if you are posting this question as a prank. If you disagree with your brother and you want to relinquish your interest in the estate, does this mean he wants you to assert your interest in the estate?
