Legal Question in Wills and Trusts in Illinois

Can I get Guardianship?

My son's 15 year old best friend has a bad home life. The boy wants to come live with me. I know I would need Guardianship to enroll him in school (he is not enrolled now) and get medical insurance for him (I don't believe he has any).

If the mom doesn't fight me on it, can I be awared Gardianship? The dad lives in another country without rights, and he has two older siblings - both living with the mother.

What if the mom does fight me on it. Better for me to fight for Guardianship, or report to DCFS and see if they can help me get Guardianship as a tempory aid?

Re: Can I get Guardianship?

Hello. In my opinion, you could be awarded a guardianship of this young man. It would make matters easier, if his mother voluntarily agreed that you be his guardian. In my opinion you would have to give notice of the petition for guardianship to the boy's father. This proceeding can be very involved. I suggests you retain an attorney. If the mother fights you for the guardianship, I believe, under the circumstances, that you have a good chance of winning, especially since the mother seems to have abandoned her son with you. Will be happy to discuss this further and in more detail.
