Legal Question in Wills and Trusts in Illinois

inheritance distribution

The judge ordered final distribution to be made on the estate and continued it to Feb 6 to provide proof of distribution to me. The opposing lawyer drafted a receipt of distribution which encompasses more than the scope of the judges order. It includes waiving notices, giving consent to all fees and agreement with the 2nd revised final accounting she drafted. I have no problem signing an acknowledgment of the distribution. That is what the judge ordered. I have been threatened that if I do not sign the paper she drafted she will stop payment on my distribution, attach all additional fees to me and turn my distribution over to the Cook County Treasurer. 1) Can she force me to agree to more than the distribution that the Judge ordered? (no additional requirements to agreement are in the order) and 2) can I draft and submit my own ''Receipt of Distribution'' as required by the Judge and limit it to 'yes' I have received this amount.

I live in NC and cannot travel to address these issues in person.

Re: inheritance distribution

Hello and Happy New Year. Many probate attorneys will ask the heirs to sign a receipt and distribution and then mail or deliver a check for

the funds to the particular heir. However, you should be treated politely and not threatened in any way. Will be happy to discuss this with you further and in more detail.
