my father passed away july 2006 my stepmother of 3 yrs is on the deed to the property which is fine but i was to have all of my dads tools and personal items that i wanted she agreed after the funeral but decided not to give me anything i am an only child 39 years old and my father always wanted me to have these things although a will was never recorded and if she has one we don't know. my attorney sent a letter but she refuses to give me anything what can i do? i do not want the property just some of the personal items

This is an unfortunate situation. However, without a will, you would have to be able to claim ownership of the property to be able to recover it.

The best chance of obtaining the property is to work through your attorney to negotiate a settlement of some kind.
