Legal Question in Wills and Trusts in Illinois

Inheritance

When both of my parents pass away, will their house

automatically be placed in mine and my sisters' names,

or must a will be made anyway?

And does the house legally have to be divided among all siblings equally (if not otherwise provided)?

Re: Inheritance

The only way the property will automatically pass to you and your sister is if your names are on the acutal title/deed of the property. If you are not listed but named in a Will then an estate must be opened so the property can be placed in your and your sisters name. I suggest your parents speak with an attorney regarding these issues.
