Probate can take quite awhile depending on the nature of assets and outstanding debts. For real estate in particular, usually it is possible to get permission from the court to sell the real estate early on in the process. However, the Court will need to approve any offer. There is a potential alternative to the probate process if real estate is the only asset. It's best to speak with a probate attorney to get more info.

I agree with Attorney Goldberg. It can depend on other factors as well - is there a will, or not? Are there minors involved? See an attorney!
