Legal Question in Wills and Trusts in Illinois

My mother passed away in April, 2011, and my father passed away in July, 2011. My mother had an outstanding skilled nursing home bill from November and December 2010. Her primary insurance paid their portion before she passed away. The remainder of her bill was sent to Medicare (secondary) two weeks after she passed. How long does the nursing home have to submit a bill to us? I keep hearing 6 months after her last will and testament was filed with the court. I must add that my parents had separate insurance policies, and that their names were not on each other's policies. Thank you for your help.

The answer to your time limit question depends on whether a probate estate has been opened for either or both of your parents. The 6 months time frame that you heard applies only from the time that publication notice of a probate estate is made, not just from the filing of a Will.

There are a lot of different facts that come into play in a situation like this. You would be well served to discuss the specifics with an attorney if you have not already retained counsel.
