Legal Question in Wills and Trusts in Illinois

My mother passed away recently and left my sister and I two small Life Insurance Death Benefits $4,000 total). The policies were through her former place of employment and only payable to the beneficiaries upon her death.

My mother was in a nursing home for a number of years and on Medicare spend-down that took her Social Security and Pension checks, her life savings, and the proceeds from the sale of her home. Do we have to turn over the Life Insurance Benefits to Public Aid to pay the $4,130 they claim is owed them?

I am not aware of any estate recovery rules that apply to life insurance. But I'm no sure. Good luck.

you are only responsible to pay your mother's debts if you agreed to be responsible. did anyone sign to guarantee payment to the nursing home if your mother did not pay the full amount do? even still, the insurance proceeds belong to you and your sister, not your mother. to discuss further, i can be reached at 312-372-5600.
