Power of Attorney

I would like to know how to give power of attorney to my sister to allow her to sell our mother's house (deceased). We (myself, two brothers and sister) were all named on the house but the realtor would like to deal with only person, so myself and my two brothers need to give power of attorny to my sister so she may sell the house. Does this require an attorney, or is just a matter of filling out a form?

It does not REQUIRE an attorney. But I would recommend one, to make sure you use the correct form and language, and to assure it is executed properly. Any attorney here or in Illinois could prepare it for you .

In order to grant a power of attorney for a real estate transaction in Illinois, the power of attorney must be executed and then recorded with the county recorder's office.

The previous two responses are correct. However, I would add that you do not need to do this just because of the real estate agent's desire to work with only one person. If you would all prefer to be involved, then tell the real estate agent that you are not interested in his or her suggestion, or find a new real estate agent.
