Legal Question in Wills and Trusts in Illinois

Power of Attorney

My mother holds a durable power of attorney for my grandmother who is incapacitated. My grandmother will be moving out of state (to Minnisota) to reside in a nursing home near my mother's two sisters. Can my mother transfer the power of attorney to her sisters? How should she go about doing this?

Re: Power of Attorney

Your mother cannot "transfer" the POA. Your grandmother must sign a new POA, naming the sisters or others as the attorney-in-fact. Designating an alternate person may help. Since POA law differs in certain states, a POA should be consistent with MN law.
