Herniated disk surgery and possible shoulder surgery

In April of 04 I was injured while rolling the tarp on my trailer. The wind got under my tarp, picked me up about 3 feet and then slammed me back down. I notified my terminal manager and then went to Occ. Med. Hosptital. They said I had pulled some muscle. They gave me some pain medecine and sent me back to work light duty. Three weeks later they finally x-rayed my back and found 5 compression fractures. I was referred to bone specialist, who ordered an MRI. After he seen the MRI he said I would need some time to heal. I went back to work in late May. Later that summer I was still having the same pain as I had the day it happened. I called the bone specialist and he ordered another MRI, this time for my neck. Work comp refused it. In March of 05 the wind got under my tarp again, this time it twisted me violently to the right. I went of Occ Med Hospital and they referred me to the same bone specialist and he immediatley ordered an MRI for my neck. It showed a herniated disk at C-6 C-7. I had surgery to remove the disk. The surgeon fused a bone between the vertebrae and put in a plate and 4 screws.The surgeon commented that the disk looked slightly decayed, meaning that it happened last year. Am I intitled to a settlement.

From what you say you probably have a case and the WC insurance should pay you for all your medical expenses, all your wage loss and a lump sum for your disability. You have a serious injury that may require future expenses and medical treatment. You may even not be able to do your job and have to be trained for some other job. All this must be taken into consideration before settling your case. The WC adjuster's job is to short change you and protect the interest of the insurance company in paying out as little as possible--your well being is not their concern--their bottom line is. You should talk to an attorney who will protect your interest and makes sure you get what you have coming and not a cent less.

There are a lot of attorneys who handle this sort of cases-you can contact my office or anyone else but the main thing is that you should be contacting an attorney because otherwise, you will be short changed.
