Legal Question in Workers Comp in Illinois

Shoulder injury

I was injured at work and will be

having a SLAP lesion repair and

subacromial decompression surgery. Does this type of surgery usually end with some sort of signifigant settlement? I was wondering if it was worth consulting an attorney for representation. I don't have any

experience or much knowledge of

the workers compensation process!

Re: Shoulder injury

I have not read any of the prior responses, but in my opinion you should definitely consult with an attorney who handles worker's compensation claims without further delay. If you do not already know a worker's compensation attorney, I'm sure that the other attorneys who responded to your question would be helpful. Or, you should feel free to contact me and I will refer you to one of the very best!

Re: Shoulder injury

Yes.

The exact amounts cannot be determined now, but in 6-8 months after surgery when you have reached "maximum medical improvement" and it will be effected by your work restrictions, if any.

Let me know if you need more specific information.

Good luck,

Re: Shoulder injury

Generally, those who have the help of an attorney in these types of situation end up with a better settlement.

You should remember that none of the people you will be dealing with (with the exception of MAYBE your doctor) are your friends. No one will be looking out for your interest unless you have an attorney to make sure that your interest is taken into account when comes time to make decisions about the extent of your treatment, its nature and when comes time to assess how serious it is for the purposes of settlement negotiations.

At this point, there are many forces that are in motion against you. I don't mean to scare you, but that is simply the nature of things.

I suggest you get an attorney to discuss the details of your case and see what sort of results would be reasonable to expect.

I hope this helps-

Taradji

Re: Shoulder injury

Dear Sirs:

In addition, you can bring a claim for what is known as a "wage differential" if in fact you are unable to return to your previous position and now have to work at a lower wage.

Please call to discuss. We are a law firm that has been in existence for over 26 years and have successfully handled many such cases.

Many thanks,

Sincerely,

Re: Shoulder injury

Yes. Under the Workers' Compensation Act, you are entitled to a settlement after you have finished your medical treatment. The amount can vary depending on many factors, including the severity of your injury, the surgery you went through, your average weekly wage, etc.

Since there are many factors, I would highly recommend you consult with an attorney to see what you should reasonably expect to get for your injury. If you do not hire an attorney, the insurance company will do all they can to save a buck and you likely could get much more. You should at least speak to an attorney so that you are armed with the knowledge of exactly what your injury is worth.

I would be happy to speak to you and I offer a FREE consultation. My information should be listed on this site. Good luck to you!

Re: Shoulder injury

Attorneys are not permitted to guarantee results, but a significant procedure will generally lead to a significant recovery. This is especially true if you have suffered any permanent or significant reduction in your quality of life. In any event, most attorneys would take your case on a contingency basis (no money up front and a percentage of the recovery), so initial consultations tend to be free.

Please feel free to call us if you want to talk.

Re: Shoulder injury

You should consult an attorney

for your own peace of mind.

You have no obligation and it should

be a free consultation, so you have

nothing to lose.

Work related injuries may result in a significant settlement if the injury causes some long term disability.

A shoulder injury like you sustained

is typically complex and surgical results vary.

Certainly you should follow your doctor's instructions. A consultation

with an experienced, understanding attorney should be worth your time.
