Legal Question in Workers Comp in Illinois

Workers Comp Concerns

I was hurt on the job getting a wire in my arm from a wire wheel tool. This is used to clean rust.

I saw a doctor at an emergency clinc on a Sunday. This had happened the previous Tuesday, however I did not know this wire was in my arm until it swelled up.

I was told I should have seen the doctor at the comp clinic they recommend. I did go there when I came back to work and their doctor tried to get the wire out, made an incision and I have stitches.

I have my own surgeon now I will go to next week. The woman in the site office is giving me a difficult time, more or less threatning me that if I do not have their surgeon who they now recommend do this I will have a hard time getting my bills paid.

Also, am I entitled to be paid for these doctor appointments and to take time off after the surgery without being harrassed.

Re: Workers Comp Concerns

Dear Sirs:

You would at some point need to comply with the request to be examined by the physician of your employer.

However, you do have remedies under the workmen's compensation act.

Please call to discuss.

Very truly yours,

Re: Workers Comp Concerns

You need to consult with a worker's compensation lawyer BEFORE you do anything else. The information you have been given about using your own surgeon may very well be correct. Please call me and I will refer you to one of the very best worker's compensation lawyers around. He will make sure that your rights are protected.
