Legal Question in Administrative Law in India

We have a agricultural land 10 acre which we used for farming. My grandfather sold 3 acre long time back to a person without any legal document. We want to get back our 3 acre from him. He is doing farming on his part. What should be language and form of legal document on stamp paper if we would like to pay him amount for 3 acre and buy it ( since there was no document for past business, land is still on my family name in government papers.) Please help. Thanks.

Your grandfather had sole the 3 acres of land by "word of mouth" or "bolee" in Hindi or "shabda denay" in Marathi which in the good old days used to be the way to sell in good faith. It makes good sense to tell your grandfather to call the person who has acquired the 3 acres of land and speak to him and ascertain his willingness to sell the land back to you. I recommend going ahead if and only if (iff) the person who is tilling the land at present is willing to sell it back to you with his free consent, so that you stand to gain from the acquisition and it bears fruit.
