Legal Question in Appeals and Writs in India
i got an award by a panel of arbitrators appointed by NSE 3 years back.The opposite party filed an appeal against the order in district court.The appeal was rejected for want of jurisdiction as the agreement excluded all courts save Courts in Mumbai.I made an application to high court for execution of the the award and the opp.party did not contest the same The High Court ordered for execution and transfered the matter to city court.The district court passed an interim order directing them not to sell their property till furthur orders.The arbitration proceeding took under sec 34 at Mumbai.Now they have filed an appeal in Mumbai high court challanging the District courts order under sec 37.Can we ask them to deposit the decreal amt before arguing their case
