Education

can I be transferred from one

university to another in 2nd year. I

have given the enterance test and

because of the mistake of one

university i was forced to study in

another university. I filed a suit and

I was sucessful in proving the fault

of that university but during the

case time one session passed. Now

the defendants university is pleaing

that they donot have any student

transfer program with the

university in which I am studying

and they wanted me to join the

defendants university in first year

but i have already completed my

first year. Is there any case for that

to which i can refer??

It is not clear in which court you won your case. The high court can give directions in your favour if the courses in the 2 universities do not differ much. You seem to have a good case.

Your only remedy at this stage may be to seek execution of decree, if any, already passed in your favour. However, the defendants may further delay execution and your studies may suffer. On the basis of this decree, you may consider approaching the High court of your State for appropriate directions.

In a different context though, the Supreme Court of India had decided in a Kurukshetra University case that a student should not suffer for University's fault.
