Legal Question in Banking Law in India

Hi,

I have bit complicated scenario with ICICI Prudential.

I have taken some policy where i was supposed to pay monthly amount so submitted ECS form for amount to be debited from my bank account every month and i got letter from prudential that ECS has been registered and the amount will go from my account every month, for first 2-3 months no amout was debited cause some technical issues where my bank (ICICI) rejected the request (POINT IS I STILL GOT LETTER THAT ECS IS REGISTERED),so i ended up paying prudential by check total of 8,000 so far, after giving the form again same thing happened so i got fadeup and asked for refund of 8k and get close the policy so I get reply back that you did not get back to us with in some days(30 or 60) so we cannot give you refund...@#$$^@#$FASFD!@#$ I still thought let go the 8k i don't have time and willingness to get more frustrated, but what i see after few months is they withdraw 10k from my bank account....N I was like WTF.....so i gave them call and asked if the ECS form was of 2k per month only and it too was not correct how the **** they took 10k from my account...the guy said all bullshit of sorry n all and said we will give you back the amount but its just getting delayed so i have two question

1) Where should i go to file case against them and how much can i claim apart from my 18k..

2) Should i file case against icici bank as well..cause with out my permission they gave 10k to some one..

Additional Details

should it be against bank or insurance company or against both?can i make them pay me more amount? not looking for money but want to teach them lesson and recover all my std phone bill

file a complaint in the District consumers Disputes Redressal forum, after issue of notice to both the bank and insurance company. take the assistance of a lawyer who is appearing in consumer forums.
