Legal Question in Banking Law in
i have issue an post dated cheque to my wife as settlement amount of divorce. with this cheque i will pay her half the settlement amount and final amount at the time of final divorce.But now i dont have sufficient fund in my account so can i make a stop payment of this cheque and allow after 2 months. In this case will there be any law problem would be there.I tried to convince her not to drop the cheque now, but she didnt agree. So i want to know can i make stop payment and pay after 2 months. And will there be any leagl action against me for doing this as per Indian law?

there can be a chq dishonour case against you u/s 138 n.i.act. she can also file case u/s 420 IPC. even if she doesnt take above action, your divorce may be kept pending.
