Legal Question in Banking Law in India

Security Chqs

I had issued Undated, Unfilled chq book to my suppliers, as the security chq books. I fear that they are going to inflate the amount and present the chqs in bank. We are in dispute with our suppliers. What possible measures can I take to save myself.

Re: Security Chqs

It is obviously great mistake on your part to issue Undated, Unfilled chq book to your suppliers, as security . Why you have kept the same still with hi. In my opinion you should file a criminal case stating detailed facts if police take it if not you may file private complaint . You are in dispute with your supplier. You may also file a suit challenging the abuse of blank cheques for securtiy . But do it as fast as you can.

Re: Security Chqs

It is better to consult a local lawyer to issue a demand notice to your suppliers to return the blank cheques signed by you with a copy to the Bank with a superscript requesting the Bank to stop payment of any cheque bearing the Nos. of the blank cheques signed by you. what you have done by handing over signed blank cheques is not proper. In such extraordinary situations, you cannot throw the problem in this forum but seek specific personal advice with a local lawyer having good banking law and practice knowledge.

Re: Security Chqs

First of all never give such undated and unfilled cheques to any one.

Urgently consult an good advocate and send him a legal notice mentioning the whole dispute and fact that they have your undated cheques with no amount filled in them.

Urgently file a suit for injunction restraning them not to deposit the said cheques.
