I am consultant (Not A Lawyer) But my wife is Lawyer. So, can we be Partner ?

Dear Sir,

I am a Consultant not a Advocate I want to start my own FIRM. My wife is Advocate. So; can i make her partner in my Firm and can i use Advocate word in my Firm.

I heard that advocate can not be partner with consultant or any non-advocate.

Please advise.

If she becomes a partner - you cannot use word 'Advocate' in firm's name. Second if she is not going to practise then she may be a partner - after withdrawing her name from Bar.

A person not an Advocate can not form a partnership firm of Advocates with Advocate/s. For a firm of Advocates, both/all partners must be Advocates only. For other activities/professions an advocate and a non advocate may come together and form a firm. But in such event, advocate partner may not be permitted to practice law.
