Legal Question in Business Law in India

I entered into a public private partnership with a government co-operative APDDCFL (www.apddcf.gov.in) to handover their sick units, start them and supply milk to them at a pre-negotiated price. They were supposed to hand them over in Oct 2011. They have delayed the same till now and now they are thinking of scrapping the agreement. I have suffered loss of INR 3,000,000 til now due to this agreement. They also had a clause where I had to pay them INR 10,500 per day if I was unable to supply them milk. Can the same clause be used to claim damages from the public enterprise.

you may file a suit for recovery of damages.

I believe there must be Arbitration clause in the agreement. So you must invoke that clause and file your claim before arbitration tribunal as per clause and take the legal recourse expeditiously.
