Legal Question in Business Law in India

hike in school fees

I am the owner of a private school . This academis session i have increased the school fees for the new admissions ( my school takes admission only in class I)from RS. 250/- TO RS.500/- AND EVEN THE PARENTS ARE WILLING TO PAY THE FEE. tHE gUARDIANS FORUM CONSISTUING OF THE PARENTS OF THE SCHOOL CHILDREN FILED A CASE AGAINST IT AND THE dISTRICT COUERT GAVE A JUDGE MENT QUASHING THIER DEMANDS OF NOT INCREASING THE FEES SINCE THEY WERE NOT GETTING AFFECTED BY THE HIKE. oNLY THE NEW ADMISSIONS WERE GETTING AFFECTED AND THEY WERE WILLING TO PAY THE FEES.

However, the High Couiry again gave an order whereby we have been asked to take admissions from the remaining parents at the earlier structure though 105 parents have already admitted their wards at the revised structure. What should I do ??

Re: hike in school fees

It appears that in the facts given by you, the High Court appears to have erred in passing the order. Your remedy lies in an appeal to the Supreme Court.

Re: hike in school fees

dear principal

i could understand the problem.

now there are two options

1. to honour the judgment.

2. to prefer an appeal to the full bench of high court.

3. also file an appeal for the revision.

4. if warranted to u can go to supreme court.

depending upon the circumstances you can file another peition seeking justification of the increase.

if warranted the name of the academy and/or school may be changed and the new admissions be transferred to the new organisation.

please post me the judgment of h.c. and can be give you a better advice.

Re: hike in school fees

Since there is a decision by the court, go on appeal - to the Supreme Court, of course.
