Legal Question in Civil Rights Law in India
my case is pending in delhi high court, my counsel filed counterclaim against plaintiff that has been registered but couldn't file written statement in original suit within 90 days. Now filed WS along with app. U/O 8, r 1 read with S 151 & condonation of delay which will be argued in next month. Now what will be the status of my case
1. If WS is not accepted, what will be the status of counterclaim
2. whether my counter claim can be treated as my defence in place of WS

counter claim will stay even if w.s. was not filed in the original suit. however, ur application may be allowed. your counter claim is not a defence.
