Legal Question in Civil Rights Law in India

Gift Deed

Dear Sir, My Uncle gifted me a house out of love and affection (Jan 2006), I accepted the same, paid the stamp duty and got it registered.

I have a registered gift deed in my name signed by both Donor and Donee.

Can he cancel the gift deed ?

Re: Gift Deed

once a valid gift deed is executed, it cannot be cancelled unless your uncle was not the owner of the same before gifting it.

Re: Gift Deed

Why would he cancel at all.Do you want to get it cancelled just like that. The gift deed in case of immovable property can not be revoked by the donor once executed or registered with the registrar office. It can be nullified only through court under certain circumstances like the donor executing the gift deed forced by donee by way of fraud, misrepresentation, coercion and undue influence, but the onus of proving the exceptional circumstances under which the giftee was executed lies with the donor.
