Legal Question in Civil Rights Law in India

right of married daughters on the fathers property

my sisters in law have an eye on the house that my father in law has left for the son by a word of mouth.my mother in law is still living. my husband once asked her to make a will stating that after her demise the house must be passed to the son, but she made an issue out of it and the matter was dropped. i want to know that without a will can the son easily claim the house solely or he has to lend the sisters (married) their share? what is the right of married daughter on the father's property?the house is still in father's name.

Re: right of married daughters on the fathers property

a married or unmarried daughter has an equal share in the house of her father. word of mouth doesnt make a difference and son can claim the entire property only if the same is bequeathed to him by will. as per the amendments, the daughters are given the equal rights qua the sons.

Re: right of married daughters on the fathers property

In the given situation, without the Will, the son can not have complete ownership of the house. After the death of the father, his property devolves by succession on his legal heirs in equal shares i.e. deceased's wife, daughters and sons will each have equal share in the property; Though it is permissible for one or more legal heirs to relinquish their share in favour of other legal heir by executing a Relinquishment Deed.
