my question is....

Can we evict a tenant who was rented 6 months before if he is irregular to pay a rent from past 3 months. i had given a rent for 11 months to an relative of mine. am telling him to vacate the house because i have to conduct my daughter marriage there after 1 month , but he is explaining me some nonsense explainations that he is not able to find any house near by. if he does not get any house till then he will shift all his goods (furniture etc...) to one of the room in my house & he will take his basic things & valuables with him. After marriage he will shift again. Till that i will try for new house or else we will adjust as stated above. So please suggest me what action should i take. Am affraid that he will raise some problem in future. & more over i have not done any legal agreement between us... please sir/maam help me out

Is there any rent agreement between you and your tenant? If there is no agreement then it is a permissible use of the premises and the tenant is under licence to use the premises and you are drawing licence fee from him. If that is so then you may terminate his licence and can seek possession of the premises through court of law. But if there is rent agreement, then you have to terminate the tenancy and have to proceed for his eviction under the prevailing tenancy Act of your state. You may proceed for his eviction on the ground of non payment of rent and also on the ground of your bonafide requirement.
