society

i m owning a flat in my name as well as my wife's name. my wife's name is 1st in the agreement. i m going thru a divorce now and have till not got the share certificates from the society. they are telling me that they will only give the share certificates to the person whose name is 1st in the agreement please help me out with this thanx regards

Your wife is entitled to her share in the property. You may better consider an amicable out of course settlement with your wife for mutual consent divorce as also division of properties and her maintenance rights.

you must have mentioned about the property distribution in your divorce petition. if yes then it can be enforced if there is an agreement and if not then you can claim even otherwise
