Legal Question in Civil Rights Law in India

In a title suite, I was plaintiff. Judgment got passed in my favour on 15th April by Hon�ble Sub Judge. During trial of this case defendants didn�t cross-examined our witnesses. They filed their documents but didn�t get it exhibited in the court also they didn�t do their final argument. Now four month has passed. Defendants have not filed Appeal. Now they are ready and trying to go in appeal. Can they file appeal after 4 months? Can they get their documents filed and exhibited in appeal case?

Did you file execuriton?

Usually there is a time limitation of 60 days to appeal before district court and 90 days before High court. but advocates usually made some excuse and succeed in filing appeal but if you will defend the exemption application then court may heard it on merit and dismiss the appeal due to delay.

they may file an appeal and get the delay condoned but in case they did not file the documents at the trial court, they will not be allowed to file the same in appeal unless they able to show that they could not file the documents despite taking due diligence.
