Legal Question in Technology Law in India

Iam a software engineer.

I resigned the job and i was in notice period.

I took emergency leave noticing my employer

that m on leave through message.

but the employer has cancelled my employment

n trying to prove that m absconding now.

i have the proof that i notified them through

msg n other email communications. so how i can take action against the

company?

Dear Sir / Madam,

When you resigned, you are required to serve the notice period as mentioned in your appointment letter or pay the Company salary in lieu thereof. You may have to either serve the notice period or send the cheque for the notice period not worked by you in the Company.

You need to serve the Notice Period, if you do not then you are liabel for action, whether the action taken by them is right or not is secondary.
