Hallo sir,

We has taken room for rent in Bangalore and we had given 40000 RS in advance and monthly rent was 4500, electricity And Water bill was separate. Agreement was for 11 month from 10 September 2011 after 6 month owner come to us told has vacant the room on 3 March of 2012 we leave the room.so now they are giving our advance so, what we can do?

Please help us.

How you vacate the room without getting advance back? WHat the owner is telling now? Have a mutual talk with the owner to get your money back rather than going legal otherwise you may be in soup

Dear Sir / Madam,

The terms and conditions mentioned in your Agreement for Leave and License are important to determine the notice period and the termination of the agreement for violations during the lease period.

I have the following questions -

1) Have you been paying the monthly rent on a timely basis during the six months you stayed ?

2) Have you been paying the Electricity and Water bill regularly on a timely basis ?

3) Have you not committed any nuisance / misuse of the premises about which your neighbour(s) have complained to the owner / landlord of the premises ?

4) If there is a notice clause in the Agreement and there is no violation of any of the above, has the owner / landlord given you a month's notice to vacate his premises ?

On termination, the owner / landlord is legally bound to refund your deposit net of above pending recoveries, if any.

did u pay in cheque or cash?

Did u have any proof that you pay him advance.

Else why u leave his accommodation, i did not understand.

If u was having agreement for 11 months then he cannot force you to evict his place.

Anyhow consult any local lawyer alongwith your docuemnt proof that youpay him advance only then you will get it back.
