Legal Question in Construction Law in India

Hi,

I am asking this question again with full clarity. Please advice me on this as soon as possible

I want to construct the first floor above my home which is in my mother's name (saledeed, Grandfather property) but we fear that my father (not living with us from past 20years)may get stay order since his signature nor he was present while saledeed was done and its his father's property. My question is :

1) Can he get the stay order from court if we started construction?

2) If he get it then how we can object that?

3) Within how may days the stay order will be issued if applied?

Thanks & Regards

your father has to make out a good ground for the grant of stay or status quo. you can object to the stay and get it vacated if obtained on false grounds.
