Legal Question in Construction Law in India

Renovation and Repairs

From the past two months we have been harresed by our neighbour who stays right above our flat. Most of the time he stops the work by forcefully entering our flat or by hitting the workers and abusing them. Last time he even made a Police complaint against us for conducting the work illegally which is not true. We have already got an N.O.C. from the Landlord. His issues are that we create a lot of noise and the drilling hammering work is weeking the structure. He is not ready to listen to anyone and just wants our work to stop. We have tried everything to satisfy his wants but still he does not want to listen. Now everytime we start work he dials 100 from his phone and the policemen stops our work. Please suggest me what to do now, we are really fedup of this man and his mentality.

Re: Renovation and Repairs

This is a pure matter of civil suit and there is no police required in this matter.

Consult a local lawyer and file a mandatory injunction suit.

Re: Renovation and Repairs

If you have all formalities completed, then you can legally complete the repairing work. This is a civil dispute, and Police has no business to do. However if police interferes, then you can also write a note to police, that police has no jurisdiction to interfere or stop the work.

You can file civil suit if you want, but it may take time.
