Legal Question in Construction Law in India

Sirs,

I have purchased a flat in Platinum City in Bengaluru in July 2011. The builder was to complete the building by providing all amenities and obtain occupancy certificate and other clearances from the respective departments. However, despite my follow ups and tens of mails, nothing much happened. Now, BDA has sent notice to few occupants that the builder has not obtained occupancy certificate under Municipal Corporation Act 1976 Section No. 310 Clause (1) and (2) and Section 461. BDA has also advised the residents to vacate the premises within 7 days from the date of notice. The builders are India Builders corporation and the seniors are not available for comments. The officials are confirming that they have committed to BDA to complete the work in next 30 days and solve all the problems. Kindly advise what the residents need to do in this regard. The reference number of the letter from BDA is BDA/AEE4(N)/119/2012-2013 dated 27.3.2013 - Notice to Occupants.

Best option for you is to approach court, by way of a Writ.
