Legal Question in Consumer Law in India

2 days back I purchased a swift from a dealer. It was 53k driven.

He told me that there is no accident on this car and is perfectly fine.

Car is 5 years old.

When for servicing I went to the maruti station they told me that the odometer reading

gas been changed to 53k. This car was last serviced 1 year back and at that time

odometer reading was 80k.

The first owner was driving the car 20k per annum, so car went over 1 lakh and somebody mangled the odometer to 53k.

I have got the last service bill from maruti of 80k mileage.

Car has 5 claims in 4+ years.

The cars driver door and rear door got damaged completely and replaced.

1. Is mangling of car odometer considered a fraud ?

2. I have the proof from last bill car is 80k driven, is that sufficient to prove in court ?

3. What are the chances of winning the case ?

4. Can I challenge him on basis of fraud ?

as far as your grievances are concerned, they seem genuine and you may approach the city civil court or the consumer court for appropriate relief.
