Legal Question in Consumer Law in India

Affidavit Authenticity

Hello Sir,

I have applied for a education loan from Panjab National Bank for my sisters course in Australia against our property. But after completing all the formalities, my loan application has been sent back to me stating that the affidavit attached with it is totally fraud and the signatures are not that of the person concerned and is done by some third person.

I want to take the bank to the court for wasting my time and money.

Before i move i want to ask, Is it possible that an affidavit dully attested by notary can be sent to Handwriting expert for verification of the person who has done signatures? Can anybody claim its authenticity? Can notary be challanged for its attestation that he has done attestation by taking money?

And if, the person concerned i.e. my mother herself says that she has done the signatures by herself, then again the bank can deny the affidavit?

Also, Bank has took another copies of signatures from my mother, but being a human being the signatures couldn't match fully to the previous ones, thereby they are saying that It Is Fraud.

So, please reply, what should i do now?

I will be thankful.

Waiting for your response.

Re: Affidavit Authenticity

In my opinion if affidavit is genuine the Bank must not refuse loan . You can take the same to handwriting expert to prove its authenticity
