Analysis of a drug

How can I get a purchased medicine (Sealed) analysed which should be acceptable to court and how should I proceed to file a suit if the drug is found spurious.

We understand that you want to get the medicine purchased by you, to be analyzed by some Government authority so that it is acceptable in courts.

With regard to this Drug and Cosmetics Act, 1940 and the rules thereunder provide that any purchaser who wants to get any medicine tested and analyzed, may apply in Form 14A of The Drugs and Cosmetics Act, 1945 along with the prescribed fees and submit the medicine to the Government Analyst.

On conducting the test or analysis of the drug, you shall receive the Report from the Government Analyst in Form 14 B of The Drugs and Cosmetics Act, 1945.

And once the drug is found spurious, a compliant can be filed under the provisions of

The Drugs and Cosmetics Act /Indian Penal Code.
