Legal Question in Consumer Law in India

Cheque Return by bank

I had received a cheque of Rs. 300.00 from my friend from Surat.

The cheque was issued by a branch manager of Co.Op. bank.

( Drawer ) on HDFC Bank, Baroda. This cheque was altered by the drawer. There are two other signatures made by the drawer Co. Op. bank against the altered words.

I had deposited this cheque in my account with Central Bank of India, Baroda.

The cheque was returned by HDFC Bank Baroda branch ( Drawee bank ) giving the reason that the cheque is altered by drawer.

Central Bank of India, my collecting banker had debited my account by Rs. 80.00 as return charges. Moreover they had kept this cheque with them for more than seven moths from the date of return of this cheque.

In this case all are bankers. All of them have performed negligently.

Can I file a case against all bankers jointy, individually or both ?

What maximum amount can I ask for as a compensation ?

What are the rates of fee to be deposited at consumer forum ?

I want to file a big amount for compensation because all are bankers who acted negligently.

Suggest the names of Advocates from Gujarat.

Re: Cheque Return by bank

You may be wasting your time, money and energy on the contemplated litigation which turn out to be just futile.

the loss suffered by you is negligible as compared to the loss of court-time you may likely to consume;

there does not seem to be any scope for such a litigation in India.
