Legal Question in Consumer Law in India

Competency

In many a cases the respondents in their arguments at final stage before the Consumer Forum plead that the forum is not competent to hear the case on one law point or the other. The Presidents do anticipate such an eventuality and at the admission stage make sure it has powers to hear the case. But in rare cases the applicants do loose the case and get diverted to other courts like civil, etc.

Can an applicant to ensure he is approaching the correct court, make a petition before a consumer forum to get direction from it whether the case if fit to be admitted.
