Late possession of flat

We purchased the resale ready flat at Nagpur,India in May'08. In the agrrement we settle two months period for the possession. From our side the cheques and everything is ready but the vendor is not providing us the possession as his tenant are not vacanting it. What can we do for this. Is there any legal help please.

Try to amicably settle the matter as far as possible. Be patient for some more time and followup continously with the Vendor. The main problem(dispute) seems to be between vendor and tenants.

If there is a property dealer involved then you can go for Consumer Complaint before Distt. Consumer Forum but if there is a private party involved then you can file a civil suit or that.For more details contact personally.

It may not be worthwhile to indulge in litigation at this stage. You should keep making efforts with the seller and may meantime write him a registered letter expressing your readiness and willingness to make the payment against delivery of possession.

Send legal notice through your attorney offering the payment and requesting the transferring of possession. If so desired by the other party, extend time to arrive on amicable settlement. Avoid, so far as you may avoid litigation unless it becomes necessary.
