Legal Question in Consumer Law in India

I had Purchased 1 micromax tab,1 prestige induction cooker and 1 eureka forbes vaccum cleaner online from timtara.com on 02.11.2012 and made online payment of Rs.12796.00 with assurance that stock of this products are available and will be delivered with in 21 days.But even after 19 weeks my ordered items are undelivered and even after 1 letter,10-11 mails and more than 35 calls I have not got my products. Now there are not responding to my call and customer care people says we cant do anything as call escalated but there is no response from any concerned department,Now I helpless as response is very negative and no other way I can contact any one else except customer support ,who simply says your issue is escalated we cant do anything every time I call and this is going on for more than 14 weeks now.Kindly help me and resolve my issue.

Dear Sir / Madam,

Your immediate recourse is to ask the Customer Support and write to the Company to immediately refund your money along with compensation of Rs. 5,000/- towards the delay and the constant follow-up costs for delivery of the products incurred by you for such a long duration of time and inform them that should you not receive the refund within a week, a Police complaint will be lodged against them.
