Legal Question in Consumer Law in India

I have purchased a split AC.
I think the same is a repaired set. It was having all heating and tool marks all over the body.
When i enquired about the same with dealer he was a bit hesitant and told me its a new product, once i started asking repeatedly
I would like to ask, is it possible for me to file a case reagarding sale or repair / second hand product at price of a new one.

As you are sold a second hand AC while you had paid for a New AC, it is a clear case for replacement with a new AC and for compensation too.

Issue lawyer notice and file a consumer action.
