Legal Question in Consumer Law in India

i had given a token amount of 1 lacs cheque to purchase a flat in mumbai , Maharashtra but the seller of the flat has not given me the documents or even given a receipt of the amount received. Now that cheque has been cleared and the amount has been transferred to his account, even then he is not giving the document and his agent has said that the papers for the agreement are being made.They are not giving any kind of document to me.Now i dont wish to go on with the deal as i feel something is wrong and if i continue i'll be cheated.I even asked them to return the token, For which they are saying they can only refund if and when the get another purchaser.If i have to approach court what steps should i take, how long can the process be and what will the possible outcome be. Could you please kindly tell me what can i do to get the token amount back.

Now a days these kind of practices are very common from the real estate companies.

Mr Rajiv is right that you may file a recovery suit. But before that you should send a legal notice demanding your money back or the proper papers concerning your deal.

You should have taken a money receipt while you gave him advance, now though you

can otherwise prove that you have given him advance for this purpose, or send lawyers

notice to comply or refund.
