Legal Question in Credit and Debt Law in India

Credit card collection

Hi,

I am an employee of '24/7 customer' at Hyderabad-India.

Coming sraight to the point, I hold a citibank credit card and a ssavings account with them. The arrangement was such that, on evry payment due date the minimum amount due on the card account was to be directly debited from the savings account. However, due to some problems, I requested citibank to stop the direct debit to which citibank obliged.

The problem is; I could not pay the credit card account for two months due to some problems and understandably was charged the late payment and interest. To my dismay, the credit card department drew Rs.5400 from my savings account without any notice, information or authorisation.

The question is : Can they do that? Can I sue them?

Re: Credit card collection

Since you've requested them to suspend your contarct with the said Bank, & as per your request they've conseded your request & as as such thet are not required to charge from you & debit the amount from your a/c, as such they've voilated the the terms of the contarct & as such you can sue in the civil court of law by way of filing a suit for damages,

Secondly the bank is deficient in their service so you can also proceed against the bank in the Consumer's court.

Since the proceedings in the court are less expenssive , i advise you to sek the help of the Cosumer forum/courts
