Legal Question in Credit and Debt Law in India

hi, somebody has filed 138 NI Act against my cheque. the case has been filed in haryana. I want to take it in Delhi as my a/c is in delhi. Is there any law possible that i could ask to transfer the case in Delhi?

if you dont have any cause of action in haryana and your bank is in delhi then the matter may itself be transferred to delhi as per the recent judgements. otherwise you can engage a counsel who can go there and tell the court that the matter can not be proceeded with there.

For transfer of a case out of State, one may approach the Hon'ble Supreme Court of India by filing a Transfer petition.

If you do not have a very strong defence, it may be better to settle the dispute by reaching an out of court amicable settlement.
