Legal Question in Credit and Debt Law in India

Good day Law Guru,

During 2008, I used to hold SBI credit card. I made a purchase of around INR 18,000.00 and I never used to get my monthly statements delivered to my residential address and hence I didn't pay the bill. I even called the bank to check if their records are properly updated with my correct billing address and they promised me to deliver the statements which has never happened.

Nonetheless, after 6 months I got a call from the collection agent asking me to pay the bills along with the dues. Since, I never had any intentions to default the payment, I asked them to settle the bill, waiving out the interest and other charges, for INR 18,000.00 and requested them to grant me 4 installments to clear the entire amount. I've received a settlement letter from SBI clearly indicating the installments. I issued 3 checks (for INR 5,000.00 each) and paid INR 2,000.00 cash and obtained receipt bearing SBI hologram. However, out of 3 checks only 2 checks were presented and the other check was not presented till date.

To my shock, on December, 2011 (after nearly 4 years) , I received a call from SBI asking me to pay the remaining outstanding which added upto INR 25,000.00. I explained the person the entire case and requested him close to the issue. He asked me to send across an e-mail to him along with the copies of settlement letter and the receipts obtained which I did without fail.

Again, since last 2 days, I was getting calls from SBI. I didn't attend those calls.

Here is the story. I would kindly request you to help me and I would be very grateful to you for guiding me on my next steps.

you may approach a lawyer and he would send a legal notice to the bank.
