Legal Question in Credit and Debt Law in India

One person has taken 23 lakhs from a lady and her brother saying he will marry her and will consider 10 lakhs as dowry and 13 lakhs as loan which he said will repay in 5 years.He has signed some times in a diary while taking part of the money.This happened 5 years ago, so far he kept on stalling the issue by giving false promises, now he is not responding properly and is avoiding the lenders.Can we file a case now,we dont have any thing on record to show he demanded dowry.Most of the payments have been made by cheque.

He has also sexually misused the lady with the promise o f marriage, Can a case be filed now? there is no proof to prove the sexual misuse.

Please advice ,thanks.

Yes, you can initiate legal action. Best is meet a local lawyer and file Criminal as well as Civil Case against the concerned person.
